At HealthSource Chiropractic, LLC (“HealthSource,” “Company,” “we,” “us,” or “our”), our mission is, and always will be, “The Relentless Pursuit of Exceptional Care.” We understand, acknowledge, and respect any individual’s right to privacy and the concerns one may have regarding privacy and security. We recognize the importance of protecting the privacy of information provided by users of our Website. 

This Privacy Policy describes how we collect, use, and disclose your personal information both online through our website (www.HealthSourceChiro.com) or any other website, portal, or platform that links to this Privacy Policy (the “Website”) and offline when you otherwise communicate with us (collectively, the “Services”). 

Certain Services, including our Patient Portal, linked to or made available through the Website, may involve the collection or processing of Protected Health Information (“PHI”) subject to the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations, as amended, including 45 C.F.R. Parts 160 and 164 (“HIPAA”). To the extent HIPAA applies, PHI collected, used, processed or disclosed through the Patient Portal or other HIPAA-covered Services will be handled in accordance with HIPAA and the applicable HIPAA Notice available here. In the event of a conflict between this Privacy Policy and the applicable HIPAA Notice with respect to PHI, the HIPAA Notice will control.  

Please read this Privacy Policy carefully. By using and accessing any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access any of the Services.

1. Who We Are; What is a Franchisee?

In this Policy, we may sometimes reference “our franchisees” – this is because HealthSource does not own or operate the individual chiropractic clinics that bear the HealthSource name. We are a franchisor, which means that we authorize independent businesses to operate under the HealthSource names and systems, but we do not control any clinical, employment or disclosure practices of our franchisees. We also do not provide any medical or chiropractic healthcare; only our franchisees will do that. When reading this Policy, please keep this in mind as our franchisees’ practices may vary from ours. 

2. Changes to Our Privacy Policy

We reserve the right to change this Privacy Policy at any time. If our Company decides to change this Privacy Policy, we will post those changes on our Website and update the “Last Updated” date above, so our users and customers are always aware of what information we collect, use, and disclose. In all cases, your continued use of our Services and products after any change to this Privacy Policy will constitute your acceptance of such change.

3. Categories of Personal Information Collected 

The types of personal information we obtain about you depends on how you interact with our Website and use our Services. When we use the term “personal information”, we are referring to information that identifies, relates to, describes or can be associated with you. In the past twelve (12) months, we have collected the following categories of personal information:   

• Identifiers and information about you, such as name, mailing address, e-mail address, telephone number, or any other identifier by which you may be contacted; 

• Demographic information, such as date of birth and gender; 

• Scheduling information, such as clinic location selection; 

• Financial information, such as payment and billing information you provide in connection with your payment for healthcare services through the Patient Portal; 

• Account information, such as username and password; 

• Location information, such as your zip code or geolocation data; 

• Health and/or insurance information, such as accident and injury information and any other documents or information pertaining to your health and medical information submitted through the Patient Portal; 

• Communications, such as your preferences, telephone conversations, email communications, or any other information provided by you through the forms we make available on the Website; and 
• Internet or other similar network information, such as IP address, browser type and version, type of device you use, operating system version, and device identifier, geographic location, pages you view, how you got to our Website and any links you click on to leave our Website, metadata and user behavioral metrics about your use of our Website and emails we send to you (including clicks and opens), metadata about how you interact with our Website. 

4. How We Collect Personal Information

Information you provide to us. We may collect personal information about you when you directly provide it to us while using or interacting with the Website. You may elect not to provide this information, such as by not registering for a user account on our Site, but doing so may prevent you from using or accessing the Site’s full features.  

Information we collect automatically. As you use the Website, we may use technologies that collect certain information about you automatically. To do this, we may use different technologies that give us information about how you access and use the Website. For more information, please see our “Cookies and Other Technologies” section below. 

Information we collect from other sources. We may also collect information that is provided to us about you from our Franchisees, third-party service providers, affiliates, customers, and partners, including our marketing and advertising partners and social media networks. We may also collect information about you from publicly available sources. 

5. How We Use the Information We Collect

The personal information that you provide to the Company may be stored, processed, and used by the Company and its affiliates for the following purposes:  

• To provide you with services, products, and to otherwise operate our business; 

• To assist us in improving our services or the content of the Website; 

• To customize your experience and identify your preferences on our Website; 

• To respond to your customer service inquiries or requests; 

• To send you marketing or other promotional offers we believe will be of interest to you or to otherwise communicate with you; 

• To prevent, detect or mitigate fraud, security, and credit risk and technical issues; 

• To comply with our legal obligations or requests from law enforcement and government agencies; 

• To conduct research analytics and data analysis; 

• To enforce or protect our rights, property, safety, or other of our users or third parties;  

• As part of due diligence for, or the consummation of, a transaction involving the merger, sale, divestiture, or other transaction involving the equity or assets of the Company; and
• For any other purpose with your consent.

6. Cookies and Other Technologies

As is standard practice on many websites, our Site uses “cookies” and other similar technologies. You can read more about cookies, related technologies, and your options for controlling or restricting our use of such technologies below. 

We use the information collected from these technologies to analyze trends and traffic patterns, to administer the Website, to track users’ movements around the Website and to gather demographic information about our user base as a whole. We may also use cookies and other technologies to (i) help us understand which parts of the Website are the most popular, where our visitors are going, and how much time they spend there; (ii) make sure that our online advertising is bringing customers to our products and services; (iii) customize your experience and provide greater convenience each time you interact with us; and (iv) provide certain features of the website, such as a search bar.  For example, we utilize Google Analytics, among other types of cookies. 

Cookies. A cookie is a small text file that is sent to your browser when you access a website. We and the third parties described below may use session cookies in accordance with this Privacy Policy. A session cookie is available only during the course of the browser session; the information is not sent to or stored on a computer’s hard drive. Closing the browser or logging off will invalidate the session cookie. You also have the choice to enable a persistent cookie, which will remember your login information each time you visit the Website.  

Web Beacons. “Web beacons” or “tracking pixels” are electronic images, tags or scripts that allow a website to access cookies and among other things, help track general usage patterns of visitors to a website. Web beacons can recognize certain types of information, such as cookies, time and date of a page view and a description of the page where the web beacon is placed.  

Your Options. You have the ability to accept or decline cookies and similar technologies (including our use of Google Analytics) through our cookie consent banner or by turning on a Global Privacy Control as further described below. However, if you choose to decline them, you may not be able to fully experience the features of the Website or services you visit. If your browsers are configured to reject cookies when you visit these pages, or if you subsequently erase your cookies, use a different device, or change web browsers, your opt-out may become ineffective and may need to be repeated.

7. Email and SMS Marketing Opt-Out

If you do not wish to have your email address used by the Company to receive marketing emails, you can opt-out by selecting the “unsubscribe” link at the bottom of our emails.  

You can cancel SMS/text-based marketing at any time. Just text “STOP” in response to any message you receive from us. After you send the SMS message “STOP” to us, we will confirm your subscription status with another SMS message. After this, you will no longer receive SMS messages from us. For SMS/text-based marketing programs we operate, we use mobile phone numbers, SMS opt-in and consent records, and related messaging information to administer the program, send messages you have agreed to receive, honor opt-out requests, and comply with law.  

Notwithstanding any other disclosures described in this Policy, this SMS-related information will not be shared with third parties or affiliates for their marketing or promotional purposes. We disclose this information to messaging providers and carriers only as needed to operate and deliver our messages, or as required by law. We restrict access to people and providers who need it for these purposes and require them to protect its confidentiality.

8. How We Disclose Personal Information

We disclose your personal information to the categories of recipients described below for business purposes, except as otherwise described in this Policy (for example, in connection with our SMS/text-based marketing programs described in Section 7). We may also disclose your personal information to any other person specified separately at the point of collection. We may also disclose your personal information as you direct us to or where you have consented to such disclosure. We may disclose, and have disclosed in the past 12 months, personal information to the following third parties: 

• With our subsidiaries and/or affiliates; 

• With our subcontractors, service providers, and other third parties we use to support our business (including marketing and analytics providers);  

• To a buyer or other successor in the event of or during a merger, divestiture, restructuring, dissolution, or other sale or transfer of some or all of our assets or equity, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information is among the assets transferred; and  

• With legal or regulatory authorities and other relevant third parties for legal reasons. 

Further, we may aggregate and/or de-identify your information so that the information does not identify you. Our use and disclosure of aggregated and/or de-identified information is not subject to any restrictions under this Privacy Policy, and we may disclose it to others without limitation for any purpose, in accordance with applicable laws and regulations. 

9. Sensitive Personal Information

Sensitive Personal Information consists of: (1) government identifiers, such as Social Security Numbers and drivers’ license numbers; (2) account log-in information (e.g., financial account or credit card numbers in combination with any required access codes or passwords); (3) precise geolocation information; (4) racial or ethnic origin, religious or philosophical beliefs, or union membership; (5) content of postal mail, email, and text messages, unless the business is the intended recipient of the subject communications; (6) genetic data; and (7) biometric information that uniquely identifies a consumer or information concerning a consumer’s health, sex life, or sexual orientation.  To the extent we collect information that is considered Sensitive Personal Information under applicable privacy laws, such information is disclosed above.  

10. Sale and Sharing of Personal Information and Targeted Advertising 

When you interact with the Website, we may use, or authorize third-party partners and service providers to use, cookies and similar technologies to improve your experience with us. Our sharing of your personal information in this may may constitute “selling” or “sharing” (for targeted advertising) under applicable privacy laws. The term “sale” may include sharing personal information to provide you with relevant advertisements. While we do not sell your personal information for money, the term “sale” is broadly defined and may include sharing personal information for monetary or other valuable consideration.  

To the extent that are activities noted above are considered “selling” or “sharing” in the preceding 12 months, we have sold or shared the following categories of personal information for the purpose of showing you ads about our services and products:

• Internet and Network Information 

To exercise the right to opt-out, you (or your authorized representative) may adjust your choices to reject optional cookies through our cookie preference center by clicking on the Cookiebot CMP Privacy Tigger icon or by contacting us using one of the methods below. You do not need to create an account with us to exercise your opt-out rights.  

In addition, some browsers offer you the ability to opt out of the sharing of your personal information by turning on a Global Privacy Control. You can turn on a Global Privacy Control in your web browser or browser extension or by visiting https://globalprivacycontrol.org/. Please see the California Privacy Protection Agency’s website at https://oag.ca.gov/privacy/ccpa for more information on valid Global Privacy Controls. At this time, we respond to browser-based opt-out signals sent through the Global Privacy Control. 

11. Your Rights

You may have certain rights relating to your personal information subject to local data protection laws. Depending on the applicable laws and your circumstances, you may have the following rights: 

• Right to Know: You may have the right to request any or all of the following information relating to your personal information we have collected and disclosed in the last 12 months, upon our verification of your identity: 

• Right to Request Deletion: You may have the right to request that the Company delete any of your personal information that we collected from you and retained, subject to certain exceptions. 

• Right to Correct: The right to correct inaccurate personal information that we maintain about you. 

• Right of Portability: The right to request a copy of your information in an accessible format. 

• Right to Non-Discrimination: You may have the right not to receive discriminatory treatment for exercising these rights. 

• Right to Appeal: You may have the right to appeal a decision we may make related to your request. To the extent you have a right to appeal a decision we’ve made about your personal information, please submit an appeal request to via info@healthsourcechiro.com. 

• The Right to Opt-Out of the Targeted Advertising, the Sale or Sharing of Your Personal Information, and Profiling in Certain Circumstances: The right to direct us not to sell or share personal information we have collected about you to third parties for targeted advertising. 
• “Shine the Light”: California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to a third party for the third party’s direct marketing purposes. 

12. Changing Your Information

You may change your personal information at any time at any of the Clinics listed on our website or on the Patient Portal on our Website. If you need assistance with updating your personal information, please contact info@healthsourcechiro.com with your request. 

13. Exercising Your Rights

To exercise your rights described above, please submit a request to us by:

Some rights require us to first verify a data subject’s identity. Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. The verifiable consumer request must: 

• Provide sufficient information that allows us to reasonably verify you are the person about whom it collected personal information or an authorized representative; and 

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. 

We may not be able to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. To verify your identity, we may request up to three pieces of personal information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent. If you do not agree with how we responded to your request, you may ask us to review our decision by contacting us through the above noted methods. 

14. Response Timing and Format

Where a response is required, we endeavor to respond to a data-subject rights requests within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver the written response by mail or electronically, at your option. The response we provide will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity. 

15. “Do Not Track” Settings

Some web browsers and browser extensions have settings that enable you to request that our Website not track your movement within our Website or across websites, including by sending “Do Not Track” signals or Global Privacy Control signals. Our Website does not obey “Do Not Track” signals when transmitted to and detected by our Website. However, our Website does recognize and respect Global Privacy Control signals where required by applicable law. However, this does not change our compliance in any other way with our Privacy Policy. 

16. Protecting Your Child’s Privacy

We follow the Children’s Online Privacy Protection Act (“COPPA”). Even though our Website is not designed for use by and our Terms of Use expressly prohibit access by anyone under the age of 18 (a “Child”), we realize that a Child may attempt to access our Website. We do not knowingly collect personal information from a Child. If you are a parent or guardian and believe your Child is using our Website, please contact us. If we discover on our own that a Child is accessing our Website, we will delete the information as soon as we discover it, we will not use the information for any purpose, and we will not disclose the information to third parties.

17. Information Security & Retention

We maintain reasonable and appropriate standards to safeguard your personal information. Unfortunately, the transmission of information via the internet is not completely secure. We urge you to take every precaution to protect your personal information when you are on the internet. Although we will take reasonable efforts to protect your personal information, we cannot guarantee the security of such information transmitted to the Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. 

We will retain your personal information for no longer than is necessary for the purpose stated in this Privacy Policy, unless otherwise extending the retention period is required or permitted by law. The data storage period may vary with scenario. The standards we use to determine the retention period are as follows: the time required to retain personal information to fulfill business purposes, including providing products and services; maintaining business records; controlling and improving the performance and quality of the Website; handling possible queries or conducting assessments of complaints; whether you agree to a longer retention period; and whether the laws, contracts, and other equivalencies have special requirements for data retention.

18. Third-Party Privacy Policies

Please be aware that other web sites when accessed through our site may collect personally identifiable information about you. The information practices of those third-party web sites linked to the Website are not covered by this Privacy Policy.
